My case is filed in EB-2 although I am eligible to apply in EB-1.
When I filed, there was no retrogression for India, and so it made no sense to apply in EB-1.
Does anyone have any suggestions?
My PD is Dec 2004
and I have a 140 approved.

I am currently working on H1B and have received my EAD and Advance Parole recently. I am planning to travel next month and want to use
my Advance Parole for this purpose. When I come back (to avoid h1b stamping again in home country). Do I need to use EAD to continue
working in US?
Thanks in advance

In case you haven't noticed, its mostly the Democrats who are opposed to H1b and Republicans who want H1b increases. The article is flawed or biased in that respect.
This story is priceless -- after all the anti-H1B and anti-immigrant rhetoric,
"The California Republican Party has decided no American is qualified to take one of its most crucial positions state deputy political director and has hired a Canadian for the job through a coveted H-1B visa."

AILA Leadership Has Just Posted the Following:
The Senators are coming, the Senators are coming! That's right, the Senate is debating the DHS Appropriations bill right now, and immigration amendments are being offered. I blogged about the Sessions E-Verify proposal yesterday. Well bill, that passed by voice vote this morning, but not before the Senate voted down a proposal from Senator Schumer to table the Sessions proposal. Senator Leahy, in an astute move prior to the vote on Sessions' E-Verify bill, amended that bill to include a permanent extension of the EB-5 Regional Pilot Program. So, Leahy's amendment permanently extending the EB-5 Regional Pilot Program was approved too!
Senator DeMint from South Carolina threw in a bill to mandate the construction of actual fences along 700 miles of the Southern Border, taking away the right of DHS/CBP to decide how best to protect that border. That has also passed.
Senator Hatch has now introduced a bill which includes positive changes including undoing the Widow Penalty, and a religious worker extension and a rural doctors program extension. You can still call the Senate Switchboard to voice your support for this latter bill, and your disgust with the Senate passage of laws without debate that will affect millions of lives and cost billions of dollars. You can reach your Senator by calling 202-224-3121.
All of these amendments, of course, must now go back to a conference committee with the House, and there is no guarantee that any of them will become law. But, lest you thought your time to relax from calling your Congressman was over, it has now started again. Get on the phone and start demanding REAL Immigration Reform, rather than this piecemeal junk.https://blogger.googleusercontent.com/tracker/186823568153827945-7232301415393625463?l=ailaleadership.blogspot.com

Bush said he wants to improve the working visas, I think the prority needs to offer to Canadians because Canadinas use the same language and education system, the distance is closer. We need to call all the senetors, the working visas.etc. need to go to Canadina citizens first.
I agree. For the genero city of canedians for using the same langwage, the goverment also pay for at least one ice hoky rink in every city. But what about the French canadians.. they should instead be called freedom canadians and directly get a green card...

My lawyer checked my application type as
"h", and stating "Spouse has an approved I-140"
Since I am filing as dependent. Should it be "b" " my spouse or parent applied for adjustment..."
Does it hurt to choose "h"? Thanks!!
If you are a dependent, you should probably choose (b). I chose (b) for my dependent wife, which is what my attorney recommended. Don't know about (h), but why complicate matters?

You should speak to an immigration attorney. That's the best I can tell. False claiming to be a U.S. Citizen can lead to a permanent inadmissibility to the US. As such, it is a serious matter and should be discussed with an attorney.

Transit Visa is Not Required in Frankfurt. Infact I had renewed passport with all pages blank. At the transit one officer asked me On what Visa are you travelling to US?
I said I have Advance Parole. That's all. The Officers are nice and friendly. They know it.
Infact I visited German Consulate at BOSTON before travelling. The Consulate General was extreemly good and told me "Not to waste money on transit visa"

This author Angela Junck seems to be a good media support. Please look at her article below:
On the other side of the debate are immigrants who are clamoring for a genuine legalization program that integrates newcomers into civic life; in short, granting newcomers immediate access to green cards. It's the simplest, fairest and most humane way of integrating immigrants.

Thanks for the info, I've sent out a note to the editors .

I have stamped from Canada 3 times before. without any issue.
I do not know the situation today. If you have all the required documents ready
and You attorney has sent a copy of your H1 extension to PIMS office at Kentucky
(For all extension petition this is required) You can stamp at Canadian US consulate
without much issues. If PIMS is not updated then you have to be ready to stay at Canada
for 1 to 3 months. so be careful before taking decisions, especially nowadays. This is my understanding.
Same thing at Indian consulates. I
f the rules have changed Please enlighten me the folks who knows about it.

I have a question about 131 application form for AP.
*****************************
From "Instruction for Form I 131"
Step 1. Fill Out Form I-131
1. Type or print legibly in black ink
If extra space is needed to complete any item, attach a continuation sheet, indicate the item number, and date and sign each sheet.
1. Initial Evidence
3. Answer all questions fully and accurately. State that an item is not applicable with "N/A." If the answer is none, write "none."
***********************************
Do I have to enter "N/A" on each and every field that is not applicable for me?
Please advice

http://www.politico.com/blogs/joshgerstein/0509/Obama_sets_WH_immigration_reform_event_for_June_8_ .html
President Barack Obama is inviting members of Congress to the White House for a June 8 meething to highlight immigration reform, an administration official confirmed to POLITICO Wednesday.
"The meeting will be an opportunity to launch a policy conversation that we hope will be able to start a debate that will take place in Congress later in the year," the official, who asked not to be named, said.
Asked if the session would be billed as a summit or a forum, like similar meetings on health care and fiscal responsibility earlier in the year, another official said, "This isnt a forum or a summit with outside groups, this is solely a meeting with members of Congress on both sides of the aisle and both sides of the issue."
Another aide said about possible labels for the meeting: "I don't know that we're going to brand this in any particular way."
During a meeting in March with the Congressional Hispanic Caucus, Obama promised to host a public event on immigration, as POLITICO reported at the time. The New York Times reported last month that officials said the session would take place in May, but POLITICO reported yesterday that the timetable seemed to have slipped. Sources close to the process said it was delayed by various logistical issues, including focus on a possible Supreme Court pick next week.
Immigration reform advocates have been pressing Obama to vow to pass immigration reform this year. He has promised make the issue a priority, but has stopped short of setting a goal of getting a bill through Congress by December.
(Thanks to POLITICO columnist Gebe Martinez for the tip.)

When you reach NSC or TSC, you talk to an IO. Who really is an IO? Are they first line of customer service at the centers? They then send requests etc to officers handling your cases?
I am trying to understand the relationship between the Customer Service agents, IOs and the case workers.
My understanding is:
Customer Service Rep (Level 1) - has access to little more information (like insights on processing times) than what you see online.
Customer Service Rep (Level 2) - has more access priviledge than CSR1, most of the time, s/he helps you open a high serverity service requests and/or direct your call to right resource to have your questions answered.
Immigration Officer (Customer Service) - Most of the people who use POJ end up in reaching IO CS, who has more insights about the case details (workflow, cards ready to be printed and etc), s/he will help you resolve the isssue or answer the question on hand.
Immigration Officer (Case Adjudication) - the one who is acutally working in the case, whom you will never be able to reach through POJ but It is possible to have your call routed through CSR2 or IO-CS - it all depends on your case issue and planet alignment.
Immigration Officer (Customer Service), Immigration Officer (Case Adjudication), the titles in the bracket are made up names to distingush the role. Long story short, both are immigration officers with different roles and access.
Others can throw more light on this
