    To everyone who reads my post. I apologize for not being clear. The article says that they are talking about eliminating the per country caps and giving green cards to STEM graduates. In my haste and excitement I should have spelled this out. Now with that said I do not appreciate the snide remark from the previous poster. This is a forum for productive discussion, not for people to be condescending. So let us rejoice that maybe people are listening to us!

    You can go to any industry financial, insurance, pharma etc but your job and duties should be similar to your current one. If your current position is *mathematician* and your new job says "consultant" it will catch the officer's attension easily. But from other threads in understood that your job description should be similar to your current ones. Please go thru some IV threads.

    Whn I entered US after visiting home country Nov 06, they gave me an I 94 till Dec 06 which was the end term of my first H1 B term.
    i got the approval for xtension. In approval notice at the bottom, i see a new I 94 till 2009.
    so now i got 2 I-94's now.
    cud any body tell which is the real one.
    next time whn i go out of this country, which i-94 i shud i hand it over to the officials??
    pls tell ur experiences..thank u

    Gurus,

    My H1B extension is pending with the VSC. I want to upgrade my H1B extension to a premium process by paying 1000 USD.

    Now, my question is - Can I do it myself thru efile or regular way using form I-907? Or should it be done only thru the employer or attorney?

    I am asking this because my attorney is charging a ridiculous attorney fees of 250 USD on top of 1000 USD for upgrading my case to a premium!

    Please help.

    I know that PERM labor gets expired if one does not file I-140 within 180 days of labor's approval date.
    I am wondering if DOL has any procedure to revive expired approved/unused PERM by filing some sort of request/appeal or by paying some sort of fees etc. or if not ,then one files a new PERM by referring the old unused approved labor for the same job and same person then DOL can give an expedited approval.

    Short answer is NO.

    You have to file a new PERM and it will be processed in the existing processing times unless its a special handling case (University profs, etc) which currently is taking around 4 months to get a PERM approval.

    I had a question about using using AC21.

    Here is the scenario: Let us say I work for XYZ Company who applied for my 140 and 485. I have approved 140, H-1b, EAD and AP.
    If XYZ laid me off or I left them for career progression or more money 180 days after my 485 was filed and 140 approved, what happens to my 485 application?

    Wouldn't USCIS question that since my sponsoring employer does not exist anymore, who am I going to work for once I get my green card? or is this coverd under AC21?


    Please advice!

    sir, if you have worked 180 days for this employer after filling of 485, there are no issues with CIS, atleast legally. However there are some unfortunate incidents going on where IO wrongfully denied 485 petitions when a person changed jobs using AC-21. I urge you to take part in IV AC-21 letters campaign which will help you and all of us to survive any unfortunate, unforseen job loss due to current downturn in economy. (http://immigrationvoice.org/forum/showthread.php?t=22182) It is actully very easy, just print 4 pages and mail it thru' USPS. Won't even cost you $2.     1. You cannot file I-907 yourself with the USCIS to upgrade to Premium. It has to be done through your employer or Attorney.
    2. However, it is legal for you, the beneficiary, to pay for it ($1000 fee), i.e., you can write a check that is payable to the "Department of homeland security".

    Form I-907 is a fairly easy form to fill. Fill it out, get it signed by your employer, and send it to the service, on behalf of the employer.
    If you know the receipt number of the H-1B application, it shouldn't take you more that 20 minutes to get it all out.

    USCIS record shows my entry year 2003 but actual year is 2005, so they came back saying 6 years is complete. Lawyer provided all the documents to prove I am here only from 2005...

    Still waiting...
